Terms of Service
Last updated November 3, 2026
These terms are an agreement between BagWit LLC, a New Jersey limited liability company (“BagWit”, “we”, “us”), and the business that creates a BagWit owner account (“you”). By creating an account or using BagWit you agree to them. If you're agreeing on behalf of a business, you confirm you're allowed to.
The service
BagWit lets your staff photograph orders and lets you store, review and export those photos. We work to keep it available and secure, but we don't promise it will be uninterrupted or error-free, and we may improve or change features over time.
Your account and team
- You're responsible for your account, keeping your password safe, and everyone you give your restaurant code to. You can remove employees or change the code at any time.
- You must have the right to photograph the orders and anything that appears in your photos, and you're responsible for following the laws that apply to your business, including telling staff how the app is used.
Acceptable use
Don't use BagWit for anything unlawful; to store content unrelated to your orders; to photograph people without their consent where the law requires it; or to try to access other customers' data, overload, probe or disrupt the service.
Free trial and subscriptions
- Your first location includes a 30-day free trial with no payment required. Additional locations require a paid subscription from the start.
- Subscriptions are $59 per location per month, plus any applicable tax, billed in advance through Stripe, and renew automatically each month until you cancel. If you subscribe during your trial, your first charge happens when the trial ends.
- You can cancel anytime from your account page (Manage billing). The location stays active until the end of the period you've paid for, and you won't be charged again. We don't give refunds for partial months unless required by law.
- If a payment fails or a subscription ends, viewing and exporting that location's photos is paused and new employees can't join. Photos continue to follow your auto-delete setting.
- We may change prices with at least 30 days' notice by email; changes apply from your next billing period, and you can cancel before then.
Your content
Your photos and order details belong to you. You give us permission to store, process and display them only as needed to provide BagWit to you. Photos are deleted according to your auto-delete setting, and when you delete them or your location. We don't keep backups of deleted photos, so download anything you need to keep longer.
Disputes with delivery platforms
BagWit provides evidence you can submit; it doesn't guarantee the outcome of any dispute, refund or chargeback. Each delivery platform decides its own cases.
Ending your account
You can stop using BagWit and ask us to delete your account at any time (see Delete your account). We may suspend or close accounts that break these terms or go unpaid, and will try to give notice first.
Disclaimers and liability
To the extent the law allows, BagWit is provided “as is” without warranties of any kind, our total liability for any claim is limited to the amount you paid us in the 3 months before the claim, and we aren't liable for indirect or consequential losses, including lost disputes, revenue or data.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us first so we can try to resolve it informally.
App stores
If you download the app from the Apple App Store or Google Play, their terms also apply to the download. These terms are between you and BagWit, not Apple or Google.
Changes
We may update these terms and will email owners about significant changes before they take effect. Continuing to use BagWit after a change means you accept it.
